Jaipur : The single bench of the Rajasthan High Court has issued a notice to Madan Jain, Director of Sanskara Resort, over misleading claims in a GST liability case concerning OYO. The case involves a GST notice of ₹2.66 crore. The court expressed concern over the unclear and misleading statements made by the complainant and granted OYO protection from forced actions. The court also observed that Sanskara Resort failed to present crucial information, such as check-out records, data on closed rooms, and the operational agreement, which were vital for the case.
The court was hearing a petition filed by OYO, which sought to quash an FIR lodged by Sanskara Resort (Saboo Sodium Chloro Limited). Justice Praveer Bhatanagar granted a stay in favor of OYO and noted that the failure to provide essential documents like booking registers and agreements reflected the resort’s negligence. The court issued a detailed order and directed the police to submit a status report within two weeks.
Senior advocates RB Mathur and Lippi Garg representing OYO stated, "The court acknowledged that the FIR was unnecessary and improper. It appears the complainant is trying to divert attention from GST liabilities. OYO has not had any business relations with the hotel for years. OYO's records clearly show that many bookings were walk-ins made directly by the hotel staff."
OYO also presented factual evidence that it had complied with all necessary regulations, including providing accurate booking information and supporting documents. The court noted that the GST department had directly requested information from Sanskara Resort, not OYO, and clarified that OYO had already provided all necessary details.
The case’s next hearing is scheduled in three weeks. OYO has pledged full cooperation with any investigation and will provide accurate information whenever required.
